This is an application for bail in connection with Gardanibagh P.S. Case No. 230 of 2017 registered for the offences punishable under Section 420 of the Indian Penal Code and Sections 63, 66 of I.T. Act.
Allegation against the petitioner is that he helped an examinee by disclosing him on mobile the answers and he was arrested at the spot.
Submission of learned counsel for the petitioner is that petitioner is a student and examinee also and he is in custody for two months.
Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.40623 of 2017 (2) dt.05-09-2017 2/2 Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail either after framing of charge or trial is commenced in this case. With the above observation, this application is dismissed.
