JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Maner P.S. Case No. 27 of 2018 for the offences punishable under sections 341, 323, 307, 379, 504 and 34 of the I.P.C.

In the FIR against the petitioners there is allegation for assaulting the informant with lathi and danda, whereas, against coaccused Sanjay Rai there is specific allegation for assaulting the informant with iron rod on his head. Against petitioner no.1 Ajay Rai there is also allegation that he snatched mobile and cash of Rs.1500/- from the informant.

Patna High Court Cr.Misc. No.21063 of 2018 (2) dt.26-04-2018 2/2 Submission is of false implication and that both parties are of the same mohalla, now good senses have prevailed between the parties and both parties have filed compromise petition in the learned court below, vide Annexure-2, and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. fairly submits that against Sanjay Rai there is allegation for assaulting with iron rod on the head of the informant.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sandeep Kumar, J.M 1st Class, Danapur in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
