The petitioners seek bail in Saraiya P.S.Case No.67/19 registered under Sections 272, 273 of I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act.

The allegation is of recovery of 257.76 litres of Indian made foreign liquor from the car in which petitioners were travelling.

It has been submitted on behalf of petitioners that they are innocent and have been falsely implicated in this case. Nothing has been recovered from the possession of petitioners. The petitioners have got no criminal antecedent and are in

Patna High Court CR. MISC. No.14555 of 2019(2) dt.14-03-2019 2/2 custody since 08 .02.2019.

Considering the facts and circumstances of the case, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge Excise, Muzaffarpur, in Saraiya P.S.Case No.67/19 subject to the conditions that (i) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned. (ii) petitioner/s shall co-operate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s. (S.
