It is pointed out by the counsel for the State that the writ petition has been filed challenging order of termination issued by

Patna High Court CWJC No.10969 of 2014 dt.29-11-2017 the Care India which, as per the petitioner's own description given in paragraph 4 of the writ petition, is a non-governmental organization. Said Care India was assisting in implementation of some ICDS schemes and is not instrumentality of Article 12 of the Constitution of India and thus the writ petition is not maintainable. On going through the averments made in paragraph 4 of the writ petition, it is quite apparent that the petitioner has described the Care India as non-Governmental Organization.
