The petitioners seek bail in anticipation of their arrest in connection with Janta Bazar P.S. Case No. 226 of 2020, dated 27.12.2020, instituted for the offences under Sections 447, 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. The petitioner No. 1 is alleged to have given
Patna High Court CR. MISC. No.25610 of 2021(2) dt.25-05-2022 2/3 orders for assault and also assaulted one Aftab Alam by means of sword. So far as petitioner No. 2 is concerned, he is said to have caused injuries to one Akhlakh in the fingers of the right hand.
It has been submitted on behalf of the petitioners that the injuries suffered by the victims are all simple in nature. It has further been submitted that there is a dispute between the parties with respect to claim over a plot of land.
There is a counter version of the occurrence and a Title Suit is also pending between the parties. Regard being had to the facts afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Saran at Chapra in connection with Janta Bazar P.S. Case No. 226 of
Patna High Court CR. MISC. No.25610 of 2021(2) dt.25-05-2022 3/3 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
