Mr. Arun Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 28-01-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 333 of 2019 registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The name of the petitioner has been disclosed by one Baidhnath Malick who was apprehended on the basis of suspicion as he was engaged in other cases of similar nature. Apart from the disclosure statement of Baidhnath Malick, there is no material against the petitioner to connect him with the crime even remotely.

Considering the facts and circumstances, the prayer of

Patna High Court CR. MISC. No.25262 of 2021(4) dt.28-01-2022 2/2 the petitioner for grant of anticipatory bail is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 333 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

It is directed that after accepting the bail bonds of the petitioner, the learned court below shall release the petitioner on interim bail and after verifying the antecedent of the petitioner, the Court below shall confirm the bail granted to the petitioner. If it is found that the petitioner has antecedent, then the bail order shall be treated to be recalled.

With the aforesaid directions and observations, this application for anticipatory bail is allowed. (Sandeep Kumar, J) Saif/-Anand Kr.
