It is submitted by learned counsel for the petitioners that petitioner No. 2 Birendra Singh has been arrested.

Accordingly the application with regard to petitioner No. 2 is disposed off.

Petitioner No. 1 being mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code.

The accusation is killing the daughter of the informant after five years of marriage by throttling her and disposing of her dead body.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.22443 of 2015 (2) dt.07-07-2015 2/2 petitioner No. 1 that there is no eye witness to the occurrence and accusation is omnibus and general. Moreover the informant has subsequently retracted from the initial version and has filed a petition to that effect before learned Court below.

Considering the aforesaid facts and the petitioner No. 1 being lady, let the petitioner No. 1, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Ramgarhwa P.S. Case No. 181 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
