The petitioner apprehends his arrest in Gogri P.S. Case No. 265/2014, registered for the offence punishable under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant named eight persons and alleged that they all armed with different weapons came to Darwaja of Pramod Yadav. Ajay Yadav, Sudan Yadav and Arun Yadav made indiscriminate firing. Nitish Kumar brother of the informant was standing at the Darwaja who also received fire arm injuries. It is submitted that Petitioner is not named in the F.I.R. After more than six months of the occurrence Nitish Kumar the injured made statement that on the order of the petitioner Arun
Patna High Court Cr.Misc. No.15931 of 2016 (3) dt.30-06-2016 2/2 Yadav caused fire arm injury to him. It appears that informant himself is an eye-witness of the occurrence but he did not name the petitioner as accused.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 265/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
