JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being the step-son of the victim is apprehending arrest in a case registered for the offences punishable under Sections 302 and 498A/34 of the Indian Penal Code.

Prosecution case is of killing the daughter of the informant namely Lalita Devi after 10 years of marriage for nonfulfillment of dowry demand and disposing of the dead body. It is submitted by learned counsel for the petitioner that the petitioner is step son of the victim Lalita Devi and the accusation of demand of dowry after 10 years of marriage by the petitioner being step son appears to be unreasonable. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.16009 of 2016 (4) dt.08-08-2016 2/2 Mr. J. N. Thakur, learned APP for the State, after going through the case diary submits that there is no eye witness to the occurrence and the suspicion was raised since there was dispute between the petitioner and the victim.

Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Darbhanga, in connection with Sadar (Bhalpatti O.P.) P.S. Case No.395 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
