The petitioner seeks bail in connection with Akbarpur P.S. Case no. 41 of 2018 registered under Sections 341, 323, 324, 333, 353, 504/34 of I.P.C. and Section 30(a) of Bihar Prohibition & Excise Act-2016.
25 lts. of foreign liquor is said to have been recovered from the house of Sosha Devi @ Rekha Devi and petitioner who happens to be husband of the grand daughter of said Sosha Devi was apprehended in course of stepping out from the house. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either
Patna High Court Cr.Misc. No.23459 of 2018(2) dt.26-04-2018 2/2 with the seized liquor or with the aforesaid house. As a matter of fact, he had gone to the house of Sosha Devi @ Rekha Devi to meet her and was apprehended by the police in the meanwhile on suspicion. He has no criminal antecedent. He has been languishing in custody since 17.02.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Nawada in connection with Akbarpur P.S. Case no. 41 of 2018.
