ANJANA MISHRA ORAL ORDER 26-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 25.12.2017 in connection with Beur P.S. Case No. 332 of 2017 registered for the offences punishable under Sections 25(1-b) A/26 of the Arms Act.

Learned counsel for the petitioner submits that actually there has been no recovery from the conscious possession of the petitioner. The I.O. has not recorded the statement of the seizure-list witnesses. The petitioner has also not been named in the chargesheet. Learned counsel for the petitioner further submits that actually he is a cement trader and because of the fact that he denied giving cement to the informant, the alleged recoveries have illegally shown against him.

No.25031 of 2018 (2) dt.26-04-2018 2/2 Having considered the entire facts and circumstances of the case and also that the petitioner has now been in custody for nearly five months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Beur P.S. Case No. 332 of 2017.
