JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.
Petitioners are in custody since 23.02.2016 in connection with Isuapur P.S.Case No.31 of 2015 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that on 12.04.2015 when he was coming from Atauli More Market and reached near the house of Rameshwar Pandey, on the order of co-accused Raghunath Rai all the accused persons assaulted the informant with farsa and Garasa as a result of which he sustained injuries and fell down.
It has been submitted on behalf of the petitioners that the
Patna High Court Cr.Misc. No.16312 of 2016 (3) dt.23-05-2016 petitioners are in custody since 23.02.2016. Petitioners have got no criminal antecedent. It is a case and a counter case between the parties. Injuries are simple in nature.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Sri B.Rai, Judicial Magistrate, Ist Class, Chapra in connection with Isuapur P.S.Case No.31 of 2015.
