Mr. SMT USHA KUMARI NO-1 ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-07-2017 This Court records displeasure over delayed framing of charge in connection with Sitamarhi Police Station Case No. 278 of 2015.
The criminal appeal, preferred by the appellant, being Criminal Appeal No. 877 of 2016, preferred against the order passed by learned Additional Sessions Judge I, Sitamarhi, whereby his application for bail was rejected, was dismissed by this Court by order, dated 09.11.2016, with an observation that the learned Trial Court should expedite framing of charge, if not already framed. It was indicated that if the charge was not framed within a period of three months, the appellant may renew his prayer for bail.
Patna High Court CR. APP (SJ) No.990 of 2017(5) dt.26-07-2017 2/2 From the report, which has been submitted by learned Sessions Judge, Sitamarhi, it appears that charge has since been framed on 14.07.2017.
If the trial is not concluded within a period of four months from the date of receipt/production of a copy of this order, the learned Trial Court shall consider releasing the appellant on bail.
This appeal stands disposed of with the observation, as above.
