JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-10-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 420, 406, 34 of the Indian Penal Code. It is alleged against the petitioner that he insisted the informant to invest in Sankalp Parivar Company and on his insistence, the petitioner invested Rs. 6,90,000/- in the aforesaid company but after maturity, the informant did not receive any amount and when she told the petitioner to return the money, he denied to return the money.

Patna High Court CR. MISC. No.22893 of 2023(7) dt.18-10-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is languishing in custody since 14.09.2022. The petitioner is ready to pay Rs. 6,90,000/-to the informant.

The petitioner undertakes to deposit 1/3 of Rs. 6,90,000/-(i.e. Rs. 2,30,000/-) before filing of the bail bonds and for rest of the amount, he undertakes to deposit the same with six equal installments within a period of six months from today.

Learned counsel appearing on behalf of the informant has accepted the offer of the petitioner. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on provisional bail for a period of six months on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Bhojpur at Ara in connection with Sahar

The provisional bail of the petitioner will be confirmed by the learned Court below after full payment of Rs. 6,90,000/- to the informant.
