The petitioner seeks regular bail in Ram Krishna Nagar P.S. Case No.137 of 2017 registered for the offence under Sections 363 and 365 of the I.P.C. Allegation against the petitioner is of kidnapping the daughter of the informant.

Submission of the learned counsel for the petitioner is that the girl is major and married lady having children also. She happens to be habitual offender of similar nature. The F.I.R. itself reveals that while the daughter of the informant, Sweta Sinha, was going to do

No.39545 of 2017 (3) dt.13-09-2017 2/2 job before 15 - 20 days earlier the petitioner lifted her in his Maruti car from the way and after recovery of the victim her statement was recorded under Section 164 Cr.P.C. after two days, i.e., on 25.05.2017 and, as such, her 164 Cr, P.C. itself appears to be manufactured and concocted one. Petitioner is in custody for 3 1⁄2 months . Heard learned A.P.P. also who opposed the prayer for bail on the ground of 164 statement against the petitioner and also threatening her.

Having heard both sides and in view of the facts and circumstances, as stated above, at this stage I am not inclined to grant bail to the petitioner. However, the trial court is directed to release the petitioner after framing charge against him in this case to his satisfaction. With the aforesaid observation this application is disposed of.
