JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This application, for grant of anticipatory bail, arises out of Khutauna P.S. Case No. 133 of 2018, disclosing offences under Sections 379, 411, 409, 120(B) of the Indian Penal Code. Prosecution case is that one truck loaded with paddy of the Government for distribution amongst the beneficiaries under Public Distribution System was coming from Darbhanga and one of the co-accused conspired with the driver of the truck and got the same unloaded at the house of one Manoj Kumar Singh and police on information raided the house of said Manoj Kumar Singh and recovered 83 bags of rice and police also came to know some bags are kept in the house of the petitioner and raided the house of the petitioner and in front of the door of the petitioner's house recovered six bags of rice. No.18551 of 2019(3) dt.06-05-2019 2/2 that he is a student and has falsely been made accused in this case and nothing has been recovered from the house of the petitioner rather the recovery of six bags were made in front of the door of house of the petitioner Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -IIcum-Special Judge (Excise) Madhubani, in connection with Khutauna P.S. Case No. 133 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
