The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that petitioner is army personnel and allegedly from whose bag, 23 litres and 250 ml. of foreign liquor were recovered. Petitioner claims that he is having clean antecedent and is in custody since 03.07.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.36041 of 2017(2) dt.10-08-2017 2/2 satisfaction of the Additional Sessions Judge-III, Khagaria - cum- Special Court, Excise Act, Khagaria in connection with Mansi Rail P.S. Case No. 12 of 2017 with a further condition that one of the bailors must be belonging to the State of Bihar. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
