Petitioner, already in custody, seeks bail in connection with Begusarai Mahila PS Case No.06 of 2017, registered under Sections 376/342/34 of the Indian Penal Code as well as under Sections 5/6 of the Immoral Traffic Act.

Allegation in brief is that the informant was married with the petitioner and on false information, she was called to a doctor's clinic wherefrom she was made unconscious and taken to several places and unknown persons used to establish sexual relationship with her, any how she escaped and returned back. Learned counsel for the petitioner submits that the petitioner is husband of the informant and she has lodged this false case because she herself used to leave the matrimonial

Patna High Court Cr.Misc. No.24929 of 2018(2) dt.27-04-2018 2/2 home invariably, in this regard informatory petition was also given and due to strained relationship, this false allegation has been levelled.

Having considered the aforesaid facts and circumstances, petitioner Mukesh Mahton @ Mukesh Kumar Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Begusarai in connection with Begusarai Mahila PS Case No.06 of 2017.
