2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 3(5) of the BNS.

3. The case of the prosecution, in short, is that the petitioner has assaulted with khaati (sharp cutting weapon) on the neck of the brother of the informant, namely, Indal.

4. Learned counsel for the petitioner has submitted that from perusal of the injury report it will transpire that the doctors have found one lacerated wound of size 6"x1"x1/2" deep over back of neck extending to left side. It has further been submitted that one more injury was received by Indal Kumar, i.e. amputation of left thumb which opined to be grievous. Learned counsel for the petitioner has further submitted that the

Patna High Court CR. MISC. No.14836 of 2026(2) dt.17-03-2026 2/2 allegation of assaulting on thumb is on the brother of the petitioner; the petitioner has not assaulted on the thumb. Learned counsel for the petitioner has submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 10.06.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Session Trial No. 302 of 2025, arising out of Mufassil P.S. Case No. 26 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-II, Munger.
