ANJANA MISHRA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Hajipur Town P.S. Case No.87 of 2016 for allegedly having committed the offences under Sections 341, 324, 326, 386, 307, 452, 504, 120B and 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that these two petitioners have not been named by the victim himself in his statement made before the police at P.M.C.H. It is further submitted that two other persons, namely, Rohit @ Rocky and Om Prakash @ Gabbar, have been named as assailants who have fired and caused injury on the person of

Learned counsel appearing on behalf of the State after perusal of the case diary has also submitted to the said effect and stated that save and except the allegations made in the F.I.R., there is no cogent material in the case diary to implicate these petitioners.

Considering the aforementioned facts and circumstances, let petitioner No.1 Arun Kumar @ Arun Sah and Petitioner No.2 Munna Sah @ Manoj Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No.87 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
