Heard the parties.

The petitioner has assailed an order of suspension dated 2-1-2023 (Annexure-3 Series). After the suspension, charge memo has been issued. Charge-memo has been communicated by letter dated 23-2-2023 issued by Assistant Inspector General of Prisons, bearing No. 1684 (Annexure- M to the counter-affidavit). The same bears a hand inscribed receiving of the petitioner at the bottom.

The petitioner, in the instant proceedings, has not put to challenge the charge memo dated 23-2-2023. The

Patna High Court CWJC No.4328 of 2023(2) dt.04-09-2023 2/2 petitioner therefore has to participate in the proceedings. 4.

No case is made out for quashing of the order of suspension, as prayed in the writ petition.

Application is dismissed.
