Two petitioners, who are in custody since 0.2.02.2018 in Mirganj P.S. Case No.22 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act,2016, have prayed for grant of bail.

At the very outset, learned counsel for the petitioners has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioners are having clean antecedent. It has also been argued that the petitioners were passengers on a Marshal vehicle, which was intercepted by the police, from which huge quantity of Indian Make Foreign liquor

Patna High Court Cr.Misc. No.28530 of 2018(2) dt.08-05-2018 2/2 was recovered. It was submitted by learned counsel for the petitioners that the petitioners were having no connection either with the vehicle or seized liquor and only he was moving on the vehicle only as passengers.

Be that as it may, considering the nature of accusation, clean antecedent and period of custody, let both the aforesaid petitioners, namely,(i) Raj Kumar Sharma @ Byash Sharma and (ii) Jalaluddin Ansari be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum- Special Judge, Excise Court, Gopalganj in connection with Mirganj P.S. Case No.22 of 2018.
