Petitioner is languishing in judicial custody since 30.11.2017 in connection with Manjhagarh P.S. Case No. 272 of 2017 for offences punishable under Section 379 of the Indian Penal Code, but later on Sections 328, 396, 412, 413, 120-B of the Indian Penal Code has also been added.

The prosecution case, as lodged by the informant, is that while his truck carrying mustard oil was on the way, the driver, cleaner and the truck along with alleged mustard oil vanished.

It has been submitted by the learned counsel for the petitioner that he is innocent, is the owner of a grocery shop and

He submits that he bears no criminal history except two cases which relate to family dispute and charge-sheet has already been submitted.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No. 272 of 2017.
