JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 573 of 2018 disclosing offences under Section 498A of IPC and Section 4 of Dowry Prohibition Act.
Petitioners happens to be the mother-in-law, father-inlaw, Nandosi and Nanad of the informant and there is allegation against them of subjecting her to cruelty, due to non -fulfillment of demand of dowry.
Submission of the learned counsel for the petitioners
Patna High Court CR. MISC. No.22401 of 2019(3) dt.07-08-2019 2/2 is that there is general and omnibus allegation and moreover, the husband of the informant has been granted bail in Criminal Misc. No. 44905 of 2019 on the ground that he will pay maintenance of Rs.2500/- per month to her.
Heard learned A.P.P. also.
Having heard both sides, considering the above submissions, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sessions Judge, Begusarai, in connection with Complaint Case No. 573 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
