JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 This application, for grant of anticipatory bail, arises out of Nabinagar P.S. Case No. 83 of 2016, disclosing offences under Sections 420, 406, 409/34 of the Indian Penal Code. Allegation against the petitioner, who is Assistant Engineer, P.M.U. and others is of commission of irregularities and misappropriation of Govt. funds in installing the hand pumps and building of house.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and his role is limited only to prepare the detailed D.P.R. and other accused persons including the Chairman, Executive Officer and others have been granted the privilege of anticipatory bail by the coordinate Benches of this Court vide order dated 07.02.2017

Patna High Court CR. MISC. No.14602 of 2019(3) dt.01-05-2019 2/2 passed in Cr. Misc. No. 36343 of 2016, vide order dated 11.01.2017 passed in Cr. Misc. No. 48948 of 2016 and vide order dated 28.10.2016 passed in Cr. Misc. No. 39966 of 2016. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Aurangabad, in connection with Nabinagar P.S. Case No. 83 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is further subject to the condition that petitioner will cooperate in investigation and appear before the Investigating Officer as and when required, otherwise, his bail bond will be cancelled.
