JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act.

The prosecution case is of recovery of 4.2 Kg of Ganja from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house. The seizure list does not bear the signature of the petitioner. The seizure list also does not depict from which part of the house the seizure was made and the said part belongs to which co-sharer of the house.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.14702 of 2016 (3) dt.02-05-2016 2/2 surrenders within a period of six weeks in connection with Raniganj P.S. Case No. 31 of 2016, pending in the Court of learned Special Judge I/C, Araria.

With the observations above, the application stands disposed of.
