JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,147,148,149,323,324,504,307,354 and 379 of the Indian Penal Code.
It is alleged that on objection being raised by the husband of the informant for ploughing his land, the accused persons assaulted the husband of the informant when son of the informant went to rescue, he was also assaulted. It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation of assault has
Patna High Court Cr.Misc. No.10448 of 2015 (2) dt.29-04-2015 2/2 been levelled and the injury has been found to be simple and there is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Kishanpur P.S. Case No. 61 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
