The petitioners apprehend their arrest in Gaunaha P.S. Case No. 172 of 2015, registered for the offences punishable under Sections 147, 148, 149, 323, 354B and 379 of the Indian Penal Code.
The informant named 14 persons and made omnibus and general allegation against them.
Patna High Court Cr.Misc. No.16342 of 2016 (2) dt.09-05-2016 2/2 It is submitted that the petitioners earlier filed Complaint Case No. 589-C of 2015, which was sent for institution and investigation. When the informant came to know about the aforesaid case he filed the present case after nine months of the occurrence. Nobody was injured. A Title Suit No. 121 of 1980 is pending in the court of Munshif, Narkatiyaganj in which the petitioner no. 2 Guchun @ Buchan Ram is intervenor. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri L.N. Tripathi, the learned Judicial Magistrate, 1st Class, Bettiah, West Champaran, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
