The petitioner apprehends his arrest in a case under Section 304B/34 of the Indian Penal Code.

The informant alleged that he married his sister, Mina Devi, with the petitioner but after some time her husband used to assault her on petty matters for non fulfillment of dowry demands. On 22.11.2015, the informant came to know that his sister was killed by her husband and other persons. It is submitted that the deceased is second wife of the petitioner. The deceased was suffering from different ailments including insomnia and epilepsy. The deceased fell down from stairs and died but it appears from inquest report that the deceased had injuries on head and she appears to have been strangulated to

Patna High Court Cr.Misc. No.16955 of 2016 (3) dt.05-07-2016 2/2 death. The post mortem report shows three injuries including one on head and death was caused due to shock and hemorrhage on account of the aforesaid injuries. The petitioner is husband and there is allegation that he was assaulting his wife on petty matters due to non fulfillment of demand of dowry.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
