The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/406/34 of the Indian Penal Code.

As per the prosecution case, co-accused Asha Thakur called the informant and his friends at the house of the petitioner and shown gold biscuit but when the informant did not agree to pay cash, again they were taken to the house of one Uday Thakur and deal was made there.

Learned counsel appearing for the petitioner submits that the petitioner is no way concerned with the said deal which was made at the house of co-accused. Petitioner is being implicated in this case only because he is relative of co-accused

Patna High Court CR. MISC. No.15493 of 2023(2) dt.18-05-2023 2/2 Asha Thakur. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate I Saran at Chapra in Mashrakh Police Station Case No. 327 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
