JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 363 and 365 of the Indian Penal Code.
It is alleged that co accused Munna Bind took the son of the informant for employment. Subsequently, Munna Bind handed over the son of the informant to this petitioner. The victim in 164 Cr.P.C. statement stated that this petitioner got the son of the informant employed in a company but the employer did not allow him to come back to his house.
It is submitted by the learned counsel for the petitioner that even as per 164 Cr.P.C. statement of the victim, no case is made out against the petitioner whereas with the same accusation
Patna High Court Cr.Misc. No.9469 of 2015 (3) dt.29-04-2015 2/2 Complaint Case No. 1210 of 2009 was filed in which the informant has filed compromise petition and in the present case also the informant has retracted from the initial version and has filed a petition to that effect before the learned court below. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Chainpur P.S. Case No. 250 of 2011 pending in the court of learned SDJM, Kaimur at Bhabua.
This application is disposed of with the aforesaid observation/direction.
