The Petitioner who is in custody seeks bail in connection with Kopa P.S. Case No. 52 of 2017 registered for the offence punishable under Sections 366(A), 379/34 of the Indian Penal Code.
The allegation against the petitioner is of kidnapping the daughter of the informant.
It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely implicated in this case due to village politics. It has been further submitted that the victim girl in her statement under Section 164 of the Code of Criminal Procedure has stated that she on threatening of the petitioner had accompanied the
Patna High Court Cr.Misc. No.44903 of 2017(2) dt.19-09-2017 2/2 petitioner and went to Jamshedpur, where she stayed for two days in a room and thereafter returned. The petitioner has got no criminal antecedent and is in custody since, 30.05.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ivth, Saran at Chapra in connection with Kopa P.S. Case No. 52 of 2017. (S. Kumar, J) ranjan/- U
