The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 364(A) of the Indian Penal Code. As per the prosecution case, informant's brother and father were abducted and after that informant received a call regarding demand of ransom.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case merely on the basis of confessional statement of co-accused, namely, Ashok Sah
Patna High Court CR. MISC. No.17526 of 2024(2) dt.14-03-2024 2/3 and Chhotu Ram, which is not admissible in the eye of law. Neither the petitioner is named in F.I.R. nor anything incriminating has been recovered from his conscious possession. During investigation, the victims were recovered and they have not whispered about the complicity of petitioner in their statement. It is further submitted that demand of ransom has not been executed. Similarly situated co-accused has already been granted bail by this Court vide order dated 19.01.2024 passed in Cr. Misc. No. 82576 of 2023. Moreover, the petitioner is languishing in judicial custody since 14.12.2023.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Dehri (T) P.S. Case No. 454 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
