====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Sri Pramod Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 07.03.2018 in Special Case No.2056 of 2018 arising out of Nadi P.S. Case No.25 of 2018 registered for the offence under Sections 30(a)/37( c) of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail.

Learned counsel for the petitioner submits that in the present case, one Maruti Van was intercepted by the police and occupant of Maruti Van, after noticing the police, started fleeing away and on suspicion, the petitioner was also apprehended as if the petitioner was also occupant of the said Maruti Van, whereas the petitioner was having no connection with the said Maruti Van, from which 35 liters of country-made liquor was

Learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. Be that as it may, considering the nature of accusation, clean antecedent and period of custody, let the petitioner, namely,Ramesh Kumar be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case no.2056 of 2018 arising out of Nadi P.S.
