2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 309(4) of the BNS.

3. The case of the prosecution, in short, is that the informant who is a truck driver was intercepted by a Scorpio vehicle and three persons from that Scorpio vehicle took Rs.30,000/- from the informant. It is further stated that the codriver of the truck took the snap of the Scorpio and on the basis of registration number, the Scorpio was searched and it was found in the house of this petitioner.

4. Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence. One

Learned counsel for the petitioner has further submitted that nothing has been recovered from the possession of this petitioner. Learned counsel for the petitioner has further submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 29.12.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Simri P.S. Case No. 326 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga.
