Petitioner is accused in connection with Lakhisarai (Kabaiya) P.S. Case No. 191 of 2015 registered under Sections 341, 323, 324, 307, 354, 504, 34 of the I.P.C. and 27 of the Arms Act.
The accusation is that the petitioner along with other accused persons armed with weapon reached at the house of the informant and started to abuse the informant and his family members. In that course, co-accused Balgovind Sharma and petitioner gave sword blow at the informant causing injury on his right palm, at that time, his mother was also assaulted by daughter of the petitioner and father of the petitioner. Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.23269 of 2015 (3) dt.12-08-2015 2/2 submits that admittedly, the occurrence took place due to land dispute and also petitioner's side received injury regarding which Lakhisarai (Kabaiya) P.S. Case No. 192 of 2015 was registered under Sections 448, 323, 324, 307, 380, 427, 337/34 of the I.P.C. and section 27 of the Arms Act against the informant of the present case and his family members. It is also submitted that it would appear from the F.I.R. itself that there is no repetition of the sword blow and petitioner, having no criminal antecedent, is in custody since 06.03.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No.191 of 2015.
