JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2017 The petitioners seeks regular bail in connection with Patory P.S. Case No. 278 of 2016, registered for offences punishable under Sections 326, 307/34 of Indian Penal Code. Allegation against the petitioners is of abusing the informant and setting her on fire.
It has been submitted on behalf of the petitioners that the materials has come in case diary that she has committed suicide and it has also come that petitioners were living separate from the deceased. Further they have been in judicial custody since 03.08.2017.
Learned counsel for the State opposed the prayer for bail and submitted that petitioner no. 1 on the instigation of petitioner no. 2 has set the deceased on fire and the deceased has made
Patna High Court Cr.Misc. No.45847 of 2017 (3) dt.17-10-2017 statement that they abused her and set her on fire. Having heard both sides, considering the fact and circumstances of the case and serious nature of allegation, I am not inclined to release the petitioners on bail, his application for regular bail is, accordingly, rejected.
