Petitioner is in custody in connection with Giriyak (Katarisarai) P.S. Case No. 472 of 2018 for the offence under sections 420, 467, 468, 379, 411, 182 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.
Referring to prosecution case, learned counsel submits that the allegation against this petitioner is that he alongwoth his cousin with a view to get insurance claim, lodged a frivolous case of snatching of his tractor in Katarisarai Police Station. It is alleged that the petitioner took the aforesaid tractor through finance in exchange of old one and got benefit ofRs.Three
Patna High Court CR. MISC. No.14515 of 2019(2) dt.08-03-2019 2/2 lacs and forty thousand and at the same time in order encash the benefit of insurance, a false case was lodged. Learned counsel for the petitioner submits that petitioner is neither owner of the vehicle nor he is concerned with the said vehicle and as such he cannot be treated as beneficiary. The petitioner is in custody since 18.12.2018. Considering the fact that petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nalanda at Biharsharif, in connection with Giriyak (Katarisarai) P.S. Case No. 472 of 2018.
