JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 352,427,341,323,324,307,379 and 504/34 of the Indian Penal Code.

The specific accusation against this petitioner to have assaulted with Farsa to the wife of the informant. It is submitted by learned counsel for the petitioner that the injury has been found to be simple of marginal size. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that witnesses during investigation suggested that the injury was caused with spade which the informant was carrying.

No.10820 of 2015 (2) dt.29-04-2015 2/2 Considering the fact that there is no accusation of repeating blow and the injury has been found to be superficial simple in nature, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Khanpur P.S. Case No. 126 of 2013 pending in the court of learned C.J.M., Samastipur.
