2. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 20(b) (ii) (C ), 25 and 29 of the NDPS Act.
3. As per the prosecution case, 63.800 kg ganja from a car which was found standing in front of cattle shed of one Dhirendra Kumar.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that the car from which ganja was recovered does not belong to the petitioner. It is next submitted that co-accused Dhirendra Kumar has been granted bail by this Court. Petitioner is a man with a clean
Patna High Court CR. MISC. No.17160 of 2026(3) dt.23-06-2026 2/3 antecedent and he is in custody since 01.10.2025. The petitioner undertakes to co-operate in the case/ trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner and submits that the name of the petitioner has come in the confessional statement of Dhirendra Kumar that the car from which the alleged contraband was seized belonged to the petitioner.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Begusarai P.S. Case No. 60 of 2025 and subject to the following conditions:- (i) the petitioner after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the Trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
(ii) The petitioner after being released on bail, is directed to mark his attendance at Nayagoan Police Station, District- Begusarai on every Sunday of the month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the
Patna High Court CR. MISC. No.17160 of 2026(3) dt.23-06-2026 3/3 petitioner.
(iii) At the time of accepting the bail bonds of the petitioner, the Court below shall verify the statement of the petitioner that he has clean antecedent. The bail bonds of the petitioner shall only be accepted if it is found that he has clean antecedent.
