The husband is facing accusation in Taraiya P.S. Case No. 60 of 2014 registered under Sections 302 and 494/34 of the Indian Penal Code for having caused death or abated suicide of his wife while living in the matrimonial home. Counsel for the petitioner submits that cause of death was asphyxia. From the impugned order, it appears that the wife was left at the matrimonial home and the petitioner went on the place of his job where he has contracted second marriage. One of the contentions of the petitioner is that some other co-accused of the case have already been put on trial and acquitted vide S.T. No. 586 of 2014.

In my view, the petitioner should also surrender and

Patna High Court Cr.Misc. No.22146 of 2015 (2) dt.09-07-2015 2/2 seek bail.

Prayer is, accordingly, rejected.
