The petitioner is aggrieved by the reservation of the post of Mukhiya, Dharmpurjafar Gram Panchayat, Block Amnour in the district of Saran which, according to the petitioner, is not in terms of the second proviso to rule 11(1) of the Bihar Panchayat Election Rules, 2006 framed under the Bihar Panchayat Raj Act, 2006.
The issue so raised by the petitioner was a subjectmatter a writ proceeding arising from CWJC No.2445 of 2016 (Braj Kishore Upadhyay & Anr. Vs. The State of Bihar) and this Court in consideration of the issues raised herein has upheld the
Patna High Court CWJC No.7190 of 2016 (2) dt.25-04-2016 procedure for categorization of the constituency which conclusion of this Court would govern the present case as well. The writ petition is disposed of accordingly. (Jyoti Saran, J) SKPathak/- U
