Petitioner is languishing in judicial custody since 24.06.2017 in connection with Garbandanga P.S. Case No. 07 of 2017 for offences punishable under Sections 406, 409, 420 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while the petitioner was posted as Panchayat Secretary in Ekda Panchayat, a sum of Rs. 2 lakhs was given for construction of road of which he has deposited only Rs. 1 lac and the rest has still to be deposited by him or details of work done by him has to be shown. It is further alleged that while the petitioner was

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and after the First Information Report was lodged, he has deposited Rs. 1 lac on 17.05.2017, as such, there is no misappropriation by him. Learned APP for the State is also present.

Considering the facts and circumstances and the materials on record, let petitioner appear before the court of learned A.C.J.M-III, Kishanganj and on satisfaction that the amount has been deposited, the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Kishanganj, in connection with Garbandanga P.S. Case No. 07 of 2017.
