Earlier prayer for bail of the petitioner was rejected by this Court vide Annexure-1 with direction to the trial court to expedite the trial and conclude the same within six months. But the same has not been concluded.
Submission of the learned counsel for the petitioner is that he is in custody for more than 18 months but except framing of charge no progress has been made in the trial rather petitioner is languishing in jail custody.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage. It appears that earlier prayer for bail of
Patna High Court Cr.Misc. No.42941 of 2017 (3) dt.08-11-2017 2/2 the petitioner was rejected with direction to expedite the trial and try to conclude the same within a period of six months. However, the period has already expired. The learned trial court is again directed to conclude it within three months, if possible conduct on day to day basis and at the same time the Superintendent of Police is also directed to submit a complete progress report in this case. With the aforesaid observation this application is disposed of.
