The petitioner seeks regular bail in connection with Brahampur P.S. Case No. 290 of 2017, registered for the offence punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is regarding the petitioner and another co-accused person indulging in firing, however, no injury was sustained by anyone.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in fact, no injury whatsoever has been inflicted upon anyone in the present incident. It is further submitted that the
Patna High Court Cr.Misc. No.29638 of 2018(2) dt.21-05-2018 2/2 co-accused person, similarly situated, has been granted bail by this Court by an order dated 11.04.2018 passed in Criminal Miscellaneous No. 10833 of 2018.
Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Buxar in connection with Brahmpur P.S. Case No. 290 of 2017.
