The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. It is alleged that on protest being made by the informant for abuse being hurled by the accused persons the informant was assaulted with stick, Farsa, axe and Dabia when Ram Jiwan Chaudhary and Ramadhar Chaudhary came to rescue they were also assaulted.
It is submitted by learned counsel for the petitioner that the accusation of assault is omnibus and general. The petitioner happens to be the brother-in-law of one of the
Patna High Court Cr.Misc. No.20727 of 2015 (02) dt.05-05-2015 2/2 named accused and in the background land dispute the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. There is counter version of the occurrence also and co-accused Veena Devi and Ram Naresh Chaudhary have been granted anticipatory bail vide Cr. Misc. No. 47376 of 2014. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Pupri P.S. Case No. 114 of 2014 pending in the court of learned Sub-divisional Judicial Magistrate, Pupri at Sitamarhi.
With the aforesaid observation, this application is disposed of.
