JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. Petitioner is an accused in Bihariganj P.S. Case No. 109 of 2017 for the offense under sections 25(1-b)a, 26 and 35 of the Arms Act.

The petitioner is in custody since 31.3.2017. There is statement on affidavit in para-3 that the petitioner has no criminal antecedent.

From perusal of the seizure list, it appears that four live cartridges were recovered from the pocket of this petitioner. Having regard to the fact that the petitioner has no criminal antecedent as stated in para-3 and the fact that he has remained in custody for nearly six months, let the petitioner,

Patna High Court Cr.Misc. No.36854 of 2017 (2) dt.19-08-2017 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Udakishunganj, Madhepura or successor court, in connection with Bihariganj P.S. Case No. 109 of 2017 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
