Petitioner is accused in connection with Goraul P.S. Case No. 439 of 2019 registered under Section 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. In fact, the petitioner happens to be unfortunate husband of the deceased and he has not killed his wife. The petitioner is rotting in custody since 24.11.2019.
Learned A.P.P. for the State has opposed the prayer for bail and submitted that there is direct allegation against the petitioner that he has killed her wife by pressing her neck. Moreover, the Post Moretm report has supported the allegation
Patna High Court CR. MISC. No.15189 of 2020(3) dt.15-06-2020 2/2 leveled in the F.I.R. As a matter of fact, there was strained relation between the petitioner and the wife. Further, the prosecution witnesses have supported the prosecution versions which is evident from paragraphs 6, 7 and 8 of the case diary. Having considered the above facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail and accordingly, the prayer for bail of this petitioner is rejected.
