The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120(B) of the Indian Penal Code and Sections 3, 4 and 5 of The Immoral Traffic (Prevention) Act. The prosecution case as per F.I.R is that police raided Nirmala Hotel, Jagdishpur and arrested two persons who confessed that they are involved in the business of prostitution. The police apprehended one lady with a man in objectionable condition and also

The apprehended accused disclosed the name of the petitioner as owner of the hotel and confessed that under the protection of this petitioner, the business of prostitution is being run in the hotel.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner had no knowledge about the illegal activities being done in his hotel. It is further submitted that except confessional statement, nothing has come against the petitioner during investigation. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on

No.15477 of 2022(2) dt.15-09-2022 3/3 furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 329 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
