03. 01.04.2016 Heard learned counsel for the Petitioner and the State.
The Petitioner seeks revision of the order dated 06.01.2016 passed by the 1st Additional Sessions Judgecum-Special Judge (POCSO Act), Begusarai in POCSO Case No. 67 of 2015 arising out of Khodawandpur P.S. Case No. 153 of 2015 (G.R. No. 116 of 2015) by which he has refused to release the wife of the Petitioner on bail. Today, the alleged victim, Nandini Kumari is physically present in Court and submits that she is aged about nineteen years and pregnant and she had gone with the Petitioner out of her own sweet-will and wants to live with him.
The Medical Report reveals that in December the victim was aged about 17 to 18 years.
Patna High Court CR. REV. No.162 of 2016 (3) dt.01-04-2016 In such circumstances, the Superintendent, Nari Niketan, Gaighat, Patna is directed to release the said girl on such bonds as it thinks necessary.
Accordingly, the order dated 06.01.2016 passed by the 1st Additional Sessions Judge-cum-Special Judge (POCSO Act), Begusarai in POCSO Case No. 67 of 2015 arising out of Khodawandpur P.S. Case No. 153 of 2015 (G.R. No. 116 of 2015) is, hereby, set aside.
The Application stands allowed with the aforesaid observation.
